By accessing or using the Nekomimi application and website (collectively, the "Service") operated by nekomimi japanese llc ("we," "our," or "us"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service.
Nekomimi is a Japanese language learning platform that combines spaced repetition, collectible card mechanics, and an original RPG battle system to help users learn Japanese vocabulary. The Service is available as a mobile application and web application.
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Certain features of the Service may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as necessary. You must notify us immediately of any unauthorized use of your account.
The Service offers both free and paid subscription tiers. By purchasing a subscription, you agree to pay the applicable fees as described at the time of purchase.
The Service may offer virtual items, currency, or other in-app purchases. All in-app purchases are final and non-refundable except as required by applicable law. Virtual items have no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash.

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, artwork, audio, video, software, and game mechanics — are owned by nekomimi japanese llc or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
If the Service allows you to submit or share content (such as guestbook entries or community features), you retain ownership of your content but grant us a worldwide, royalty-free, non-exclusive license to use, display, and distribute that content in connection with the Service. You are solely responsible for the content you submit and represent that you have all necessary rights to share it.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEKOMIMI JAPANESE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless nekomimi japanese llc and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property, disclaimers, and limitation of liability) will survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Texas.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or within the app. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
